Every potential trademark application begins with the search. Our office will conduct, without cost or obligation, a preliminary search for the exact word phase by others in the same classification of goods or services as your business. We offer preliminary trademark searches to current and prospective clients at no cost or obligation.
If no conflicts are found, and if you wish to commit to the registration process, the next step is a comprehensive search, for which we do take a deposit. In this more thorough evaluation, we cross-check your proposed mark against the common variations of your proposed mark, including most domain names. If we determine (after consulting with the client) that the mark will likely have conflicts and not be registered, the deposit is refunded, less one hour of time at our normal billing rate (even though the comprehensive search may take longer than one hour). If we believe the likelihood of a conflict is small, we will apply your entire deposit toward the trademark application fee.
